Court upholds judgment in RIO trademark dispute

The Shandong High People's Court rejected the appeals and upheld the first-instance judgment in a trademark dispute involving RIO-associated Shanghai Bacchus Liquor and several other companies. The first-instance court had found that the defendants' conduct infringed Bacchus's registered trademark rights and ordered company-name changes and compensation.

一审法院判决判决为，限锐澳公司在判决生效之后二十日内变更企业名称，且名称中不得含有“锐澳”整体字样；锐澳公司、冰锐公司赔偿巴克斯公司经济损失及合理开支共计360万元，力量公司在100万元范围内承担连带责任等。
一审法院认为，巴克斯公司系“锐澳”注册商标的权利人。本案中，泽旭超市、锐澳公司、冰锐公司、力量公司分别为涉案被诉产品的生产者、运营商和销售者，按照相关法律规定，均构成了对巴克斯公司注册商标专用权的侵权行为。
天眼查App显示，近日，金锐生物科技（中山）有限公司、广东力量酒业有限公司等侵害商标权纠纷二审民事判决书公开，审理法院为山东省高级人民法院。本案裁判结果为驳回上诉，维持原判。且本判决为终审判决。
