Overview
The Association des Juristes de l'État (AJE) is the largest professional union representing lawyers and notaries employed by the Government of Quebec. With more than 1,150 members spread across provincial ministries, agencies, and certain non-public-sector bodies, the AJE serves as the collective bargaining agent for legal professionals in the Quebec public service. More than 65% of its members are women. The AJE represents six distinct bargaining units, each with its own working conditions: the public service (909 members), Revenu Québec (177 members), the Autorité des marchés financiers (51 members), the Régie de l'énergie du Québec (7 members), Investissement Québec (12 members), and the Protecteur du citoyen (1 member). This structure reflects the gradual exclusion of certain government lawyers from the core public service and their integration into separate agencies over the years. Governance of the AJE is vested in a seven-member board of directors, including a president, vice-president, secretary, treasurer, and three members drawn from a council of representatives. The council of representatives comprises approximately fifty union representatives across as many workplace sections, each section consisting of 10 to 30 jurists. These representatives facilitate communication between the AJE's governing bodies and their section members and monitor the application of the collective agreement. The association traces its origins to the mid-1960s, when the Syndicat professionnel des avocats de la fonction publique (SPAFP) and the Syndicat professionnel des notaires de la fonction publique (SPNFP) were formed. These two groups merged in 1967 to create the Syndicat des avocats et notaires de la fonction publique (SANFP), which in 1991 became the Association des juristes de l'État. The AJE was formally accredited in 1996 to represent all lawyers and notaries in the public service, and it signed its first collective agreement in 2000. In addition to its union activities, the AJE awards a prize for the best text on a public law topic or a private law point of interest to public administration, presented at the Conference of State Jurists. The association is part of a broader network of Canadian government lawyer associations, including counterparts in Alberta, New Brunswick, Ontario, Manitoba, Saskatchewan, British Columbia, and at the federal level.
History
The Association des Juristes de l'État (AJE) traces its roots to the mid-1960s, a period of significant development in Quebec's public administration. On June 4, 1965, the Act respecting the Ministère de la Justice came into force, setting the stage for the organization of legal professionals within the provincial government. On September 29, 1965, the Syndicat professionnel des avocats de la fonction publique (SPAFP) was constituted, followed on January 15, 1966, by the Syndicat professionnel des notaires de la fonction publique (SPNFP). These two unions represented lawyers and notaries separately in the public service. The first negotiated regulation of working conditions for the SPAFP and SPNFP was adopted on October 13, 1966. A major consolidation occurred on December 7, 1967, when the two unions merged to form the Syndicat des avocats et notaires de la fonction publique (SANFP). This unified body represented both professions within the public service. On December 8, 1987, the government adopted a Directive concerning the working conditions of lawyers and notaries, further formalizing the framework for these professionals. In 1991, the SANFP changed its name to the Association des juristes de l'État (AJE), reflecting a broader mandate and identity. A key milestone came on January 10, 1996, when the AJE was accredited to represent all lawyers and notaries of the public service. This accreditation consolidated its role as the exclusive bargaining agent for these professionals. Subsequently, several groups of government lawyers were excluded from the public service and integrated into separate agencies, each with its own bargaining unit. On June 2, 1997, lawyers employed by the Régie du gaz naturel within the Régie de l'Énergie were excluded from the public service. On August 21, 1998, lawyers at the Société des développements industriels du Québec within Investissement Québec were similarly excluded. On December 11, 2002, lawyers at the Commission des valeurs mobilières were excluded from the public service and joined the new Agence nationale d'encadrement du secteur financier, which later became the Autorité des marchés financiers. On April 1, 2011, lawyers at the ministère du Revenu were excluded from the public service and joined the Agence du revenu du Québec. On July 1, 2011, lawyers at the Agence de l'efficacité énergétique became employees of the ministère de la Justice. The AJE signed its first collective agreement for public service lawyers on March 30, 2000. On June 27, 2005, an agreement to extend the 2000 collective agreement was reached between the Government of Quebec and the AJE. On December 16, 2005, the Act respecting working conditions in the public sector extended public sector collective agreements until March 31, 2010. On February 22, 2011, the Act ensuring the continuity of legal services within the government and certain public bodies extended the working conditions of state lawyers and criminal and penal prosecutors until March 31, 2015. On July 7, 2011, the AJE agreed on a tentative agreement on working conditions for the period from April 1, 2010, to March 31, 2015. On July 14, 2011, AJE members ratified the tentative agreement with 94% approval. Today, the AJE represents over 1,150 members across six bargaining units and continues to advocate for the professional interests of government lawyers and notaries in Quebec.
