ESXi open-source licensing litigation
Christoph Hellwig, with support from the Software Freedom Conservancy, pursued litigation in Germany alleging that VMware ESXi incorporated GPLv2-covered Linux code in a way that violated related copyright and source-disclosure obligations. VMware denied that ESXi was a derivative work of the Linux kernel and maintained that it had met its obligations for GPL-covered components. The case was dismissed in 2016 and an appeal was dismissed in 2019 on procedural grounds.
