Court rules in vivo trademark infringement case

The Futian District Court in Shenzhen found that one defendant infringed vivo's registered trademark by using a similar "vivi" mark on phones. The court ordered that defendant to stop producing and selling products bearing the mark and remove it from infringing inventory, and ordered the two defendant companies to pay vivo compensation and litigation-related costs.

经过一年的取证审理，法院认为某通公司在未经原告许可的情况下，使用与原告第9773708号（图1）注册商标近似的“vivi”标识(图2)，侵犯了原告的注册商标专用权。
要求被告其立即停止生产、销售带有“vivi”标识的产品，并去除库存侵权产品上的侵权标识。并要求被告某通公司赔偿原告经济损失103.5万元及诉讼费用等合理开支10万元，而某讯公司赔偿原告经济损失20万元及诉讼费用等合理开支2.6万元。
