Viva sues MTN over Kwata Esimu caller tune

Viva contends that MTN used and sold the song Kwata Esimu as a caller tune without authorization or consent, and seeks royalties, compensation and an order restraining continued sales. The court registrar summoned MTN to file a defense within 15 days. These are allegations in the suit, not a determination of infringement.

The Civil Division registrar, Jameson Karemani has summoned MTN to file their defense within 15 days before the case is fixed for hearing.
They however, contend that MTN which provides caller tunes to customers at Shs 700 monthly, went ahead to use the song without their consent.
