Legality and consent controversy surrounding the land purchase
The Transylvania Company’s purchase was controversial because private acquisition of Indigenous land and creation of an unauthorized colony conflicted with the Royal Proclamation of 1763 and the laws of Virginia and North Carolina. The agreement was also opposed by Cherokee leaders who did not consent to or recognize it.
