Buyer sues Mandarin Oriental Boca Raton developer over $1.23 million condo deposit

New York doctor Sajid Malik filed a complaint on Friday in Palm Beach County Circuit Court against developer Via Mizner Owner III, LLC and escrow agent First American Title Insurance Company, seeking return of his $1.23 million deposit on a $4.1 million unit at The Residences at Mandarin Oriental in Boca Raton. The suit alleges the Tower 105 project remains far from complete, that no closing occurred by December 31, 2025 despite a December 2022 estimated completion date, and that the developer never responded to an August default notice and refund demand. It also asks the court to declare that First American must pursue a $410,000 surety bond on Malik's behalf, and notes that other Tower 105 buyers have filed similar lawsuits over deposits the developer has refused to return.
