Ian Pearl insurance-coverage controversy
Guardian terminated the group insurance plan covering Ian Pearl, a New York resident with muscular dystrophy who required continuous nursing care. A federal court ruled that the company could terminate the entire plan, but the decision attracted public criticism. A trial-related memo describing costly policies in disparaging terms became public. Guardian apologized to the Pearl family and agreed to continue coverage for Pearl and two other patients. The controversy contributed to New York’s adoption of legislation known as Ian’s Law, which requires comparable replacement coverage in specified plan-cancellation situations.
