  1. Swiss-franc-linked mortgage controversy

mBank was among the major Polish banks that granted foreign-currency mortgage loans, particularly loans linked to the Swiss franc. The appreciation of the franc against the Polish zloty increased borrowers’ repayment burdens and outstanding debt values. Borrowers disputed the adequacy of risk disclosures and challenged contractual currency-conversion provisions. Some clauses used in mBank agreements were included in Poland’s unfair-clauses register, and legal proceedings followed, including a class action brought by 1,247 debtors. The controversy also attracted wider regulatory and supervisory attention involving the bank’s parent company.
