Legacy Mortgage sued over alleged foreclosure threat on discharged debt

    Lawsuit filed

A married couple in Ceiba, Puerto Rico, filed suit on August 13, 2026, in the US District Court for the District of Puerto Rico against debt buyer Legacy Mortgage, LLC and its collection law firm Rivera-Munich & Hernández Law Offices, P.S.C., alleging they unlawfully tried to collect and threaten foreclosure on a debt discharged in bankruptcy, in violation of the Fair Debt Collection Practices Act and the discharge injunction. The suit also seeks to represent a class over collection envelopes that displayed a Social Security number and foreclosure-related language. The claims are allegations only and no court has ruled.

    Source excerpt

    • The claims run under the federal Fair Debt Collection Practices Act and the discharge injunction - the bankruptcy protection that stops creditors from chasing a debt once a court has discharged it.
    • The suit says the outside of the mailing carried the wording "LEGACY - EJECUCIONES RESIDENCIALES - N/E: L-0022 - C/A" - a reference to residential foreclosures - alongside one homeowner's full Social Security number, in view of postal workers and anyone else who handled the mail.
    • For now, these are allegations only. No court has ruled on any of the claims.
