EU fines Kingspan €40m for misleading information in abandoned Trimo deal probe
Fine or penalty
EU antitrust regulators fined building materials maker Kingspan €40m for providing incorrect and misleading information during a four-year European Commission investigation into its abandoned acquisition of Slovenian rival Trimo. The Commission said Kingspan provided misleading information about how it tracks penetration rates for mineral fibre sandwich panels and the availability of bidding data, as well as incorrect information about board members' involvement in certain matters. Kingspan said it would appeal the fine in full.

Building materials maker Kingspan has been fined €40m for providing incorrect and misleading information during an investigation into its abandoned acquisition of a Slovenian rival, EU antitrust regulators said today.
Kingspan announced its plan to acquire Trimo in 2021 but scrapped the deal in April 2022 after the EU antitrust watchdog warned that the acquisition could jack up prices and reduce quality.
The sanction followed a four-year long investigation by the European Commission, which is the EU competition enforcer, and underscores its tough policy against such infringements of EU merger rules.

Grenfell Tower fire and building-product scrutiny
Kingspan supplied K15 insulation used in part of the Grenfell Tower refurbishment. The subsequent public inquiry examined the product's testing and certification history, marketing, technical claims and employee conduct. The inquiry criticized aspects of Kingspan's historical conduct but distinguished K15 from the ACM cladding panels identified as the principal cause of the rapid external fire spread. Kingspan has denied that its product caused the disaster.
