ELPC and Earthjustice sue USDA over REAP anti-solar policy

    Lawsuit filed

The Environmental Law & Policy Center and Earthjustice filed a lawsuit against the U.S. Department of Agriculture on behalf of farmers, solar developers and installers, grant writers and related organizations. The suit alleges that USDA unlawfully imposed anti-solar eligibility criteria on the Rural Energy for America Program and abruptly and retroactively changed the program rules. The lawsuit asks the court to invalidate USDA's new anti-solar policy and to order USDA to process REAP applications under the rules that were in place when USDA received them.
